Pablo, Salish Kootenai Tribal Headquarters, Monday, September 10th, from 9:30 a.m. to 11:30 a.m.
Superintendent Richard Whitesell, Bureau of Indian Affairs, Flathead Agency, has announced plans to curtail livestock trespass on Indian owned lands on the Flathead Reservation.
The plan, which has already been implemented, calls for immediate investigation of reports of trespass, intense monitoring of verified trespass situations and assessment of penalties and damages under terms of the Code of Federal Regulations.
Paragraph 151.24 of Title 25 of the Code of Federal Regulations states: "The owner of any livestock grazing in trespass on restricted or trust Indian lands is liable to a penalty of $1 per head for each animal thereof for each day of trespass, together with the reasonable value of the forage consumed and damages to the property injured or destroyed."
Under ihe Code of Federal Regulations several acts are prohibited, including "Allowing livestock to drift and graze on restricted or trust Indian land without an approved permit." This stipulation, in effect, requires owners of livestock to prevent their livestock from drifting onto restricted or trust Indian lands by fencing or herding.
The Superintendent also announced plans to seek injunctive relief to prevent further trespass through the federal court system if necessary.
It is hoped that implementation of this plan will curtail all trespass situations effectively.
Sincerely yours,
Richard Whitesell Superintendent
