Logging Units Closed To Hunting
The Division of Enforcement and Wildlife would like to warn all Tribal Members about hunting in active logging units- these areas are closed to hunting. We try to post these areas but the signs are always being torn down by vandals.
If you are caught in a Closed Area hunting, you can be charged under Section 38: Violation of an approved Tribal Ordinance, which reads: "Any Indian who violates an ordinance promulgated by the Tribal Council and legally in force, shall be deemed guilty of an offense and upon conviction thereof shall be fined in an amount not exceeding $180.00 or sentenced to labor for a period not to exceed three (3) months."
Also if you are caught tearing down or destroying signs you can be charged under Section 15: Malicious Mischief, which reads: " Any Indian who shall maliciously disturb, injure or destroy any livestock or other domestic animal or other property, shall be deemed guilty of Malicious Mischief and upon conviction thereof shall be sentenced to labor for a period not to exceed six (6) months and/or a fine not to exceed $300.00."
Any non-members who goes upon Tribal lands without permission of the Confederated Salish & Kootenai Tribes or who willfully destroys,defaces or removes any sign erected by an Indian Tribe or Government Agency is subject to arrest and prosecution under the provisions of Title 18, USCA Sections 1164 and 1165.
A Tribal Recreation Permit, issued by the Confederated Salish & Kootenai Tribes, constitutes permission to use this area for fishing and recreational purposes as defined by the Confederated Salish and Kootenai Tribal Ordinance 44B.
