Transcript	House To Skalp SB 268 RESERVATION FORESTS CLOSED Ronan: Extremely dangerous fire conditions in forests of the Flathead Reservation have forced a suspension of all forest uses. Acting Agency Superintendent Lyle B. Baxter announced August 2 7 that the 4 0 0,0 0 0 acres of the reservation forest will be closed until further notice. He said exceptions to the order will be made by permit to persons living in forested areas, firefighters and forest managers and persons using numbered highways and campgrounds ajacent to numbered highways. Application for permits may be made at the Bureau of Indian Affairs Office in Ronan. Fire Control Officer Roy Montgomery noted the ban applies only to forested lands, not all lands on the reservation. He said most of the Flathead River and Flathead Lake will remain open and said most of the the valley lakes and reservoirs and the Jocko River up to r the canyon will not be closed. Montgomery said the order will be enforced on forested lands by forestry personnel, BIA agents, Tribal Law and Order and County Sheriff's Deputies. He said violations of the order could be a federal offense and urged all persons to comply. Montgomery said that as of August 2 2, there had been 7 9 fires on the reservation forest this year. S. House of Representatives is going to recommend that tribal zoning authority be taken out of a previously passed Senate bill on National Land Use Policy. The subcommittee, under the Committee on Interior and Insular Affairs, has distributed a memo on its recomended legislation which would "delete the requirements for methods of control or implementation, including authority to enact zoning ordinances" from the reservations portions of Senate Bill 268. The U.S. Senate passed the bill in June. It was designed to give state and local governments, including Indian tribes, federal assistance and outlined authority to draw up land use plans and enforce them. The Indian portion of the Senate's bill, Title Five, gave tribes a cut in the $200 million nationwide budget to assist in "developing and administering a land use program for reservations and other tribal lands of such tribe" The Senate bill notes that naming tribes as the zoning authority for reservation is necessary because "Indian people are the rightful parties to plan Indian land" and "State and local governments do not possess the authority to conduct such activities on Indian land." The proposed watered down version being considered by the house is evidently a response to stiff reaction from whites on this and other Indian reservation. The memo from the Interior and Insular Affairs subcommittee on environment, of which eastern district Montana Congressman John Melcher is a member, claims the Senate bill does "not attempt to deal with the problems of Palm Springs and Flathead reservation and other situations." The memo continues saying that the legislation it is proposing would preserve the "status quo, whatever that may be." The "status quo" referred to in the subcommittees memo can only mean continued white (cont. on next page) Dixon: Tribal members will not only be exempt from future state income tax, they are also entitled to refunds if they have paid state taxes for the past five years... that is the way a U.S. Federal District Court order read The order from the Missoula Division District Court followed notification in July that the Montana Department of Revenue would no longer attempt to assess income taxes against tribal members living on their own reservations and receiving income from the reservation. The District Court order, however, went further by stipulating that the state must refund taxes paid by reservation tribal members during the past five years. The action was taken when the district court dismissed a case against Eugene and Clara Howlett and other mem- bers of the Confederated Salish and Kootenai Tribes. The decision to no longer tax Indians living on their reservations was based on a January decision by the U.S. Supreme Court. The nation's highest court decided the state of Arizona could not collect $16.20 in back taxes from Ros-aling McClanahan, a Navajo Indian working on the Navajo Reservation. Tribal members who live and draw their income from the Flathead Reservation who have been paying state income taxes over the past five years are urged to contact Tribal Secretary Fred Houle, Jr. at the Dixon Tribal Headquarters...246-3595. Special arrangements will be made to assist members entitled to a refund with filling out applications. Postponed Dixon: An election to deter mine whether 18 year olds can vote in tribal elections has been postponed. The balloting was to have been held Sept. 8. The election on the constitutional amendment was called in July by the Secretary of the Interior. The vote would have opened to tribal members the question of whether or not the 3 8 year old tribal constitution should be amended to allow 18 year olds to vote in tribal elections. But the election was post poned after tribal attorneys submitted briefs questioning the legality of a decision by the Secretary of the Interior to allow off-reservation mem-
