Permît Case in Court
Caring for the Reservation Forests
. Missoula—A case involving a non-member fishing on Flathead Lake without a Tribal Recreational Use Permit has finally gone to court.
Harlan F. Pollmann, Poison, appeared in Federal District Court in Missoula Wednesday after receiving a summons Monday. The information against Pollmann was filed June 1.
During an initial arraignment Wednesday, U. S. District Court Judge Russell Smith gave Pollmann and his Arrorney C. B. McNeil, Poison, 20 days to file a defense brief. The Tribes— technically the U. S. government—will then be given an additional 20 days to file a brief. The government's case is being handled by Deputy U. S. Attorney Robert Gannon.
Pollmann was released from custody on his own recognizance.
The preliminary arraignment was continued until sometime in November.
The case is seen as a test of the Tribe's right to extend the Recreational Use Permit System to Flathead Lake.
