Missoula—The day after the Supreme Court refused to take jursidiction over Justice of the Peace J. G. Lamoreaux (in a trial which had acquited Joe Wheeler of sale of untaxed cigarettes), Missoula County filed an appeal with the District Court asking for an opinion on jurisdiction.
The action, filed Tuesday, asks the Missoula District Court to "determine whether or not the state has jurisdiction" on untaxed cigarette sales on the Flathead Reservation.
The new action focuses on Justice of the Peace John Moon's refusal to hear the case because of lack of jurisdiction. The County Attorney's office says that if the District Court does decide the state has jursidiction in reservation untaxed cigarette sales, the case will be handed back to Justice Court.
