U. S. Supreme Court decides to route water lawsuit back to appeals
Another lawsuit involving the Flathead Indian Irrigation Project is in the news: It was announced May 13 that the U. S. Supreme Court will not review an appeal by non-Indian irrigators to overturn an appeals court's instream flow decision that favored a core fisheries over irrigation here.
The court left intact a ruling from the Ninth Circuit Courtof Appeals that said, in part, "aboriginal fishing rights se-
cured by treaty are prior to all irrigation rights.. .Only after the (Indian) fishery waters are protected doe the Bureau of Indian Affairs... have a duty to distribute fairly and equitably the remaining waters among irrigators of equal priority."
The case in now due to work its way back through the court system, where it will probably end up on the desk of District Judge Charles Lovell once again, according to BIA Flathead superintendent Wyman Babby.
In the meantime, the Tribes is still interested in forming a joint advisory board with the irrigators to address water-management issues. A plan to do so, submitted to the Joint Board of Control months ago, was dismissed by the irrigators.
"A good plan for water management and conservation is needed," Tribal Chairman Mickey Pablo said. He added that he planned to contact the JBC to see how it feels about the idea of the joint advisory committee.
