Joint Board lawsuits attack Indian self-determination, says Chairman
"It's an outright attack against the Tribes' legitimacy as a government, and an unabashed grab for the control of Reservation resources," Tribal Chairman Ron Therriault says of the latest Mission Valley Power development.
"We can't afford to take this lightly. It's time for the Tribal Council and the membership to sit down and give
some serious thought about what we should do to get the message out that this is an Indian reservation and we are committed to doing whatever is necessary to ensure its continued existence as our homeland now and for future generations."
Those strong words were in response to the news that the Joint Board of Control has filed two lawsuits in federal court in a last-ditch attempt to gain control of the Flathead Indian Irrigation Project.
"The lawsuits might name the Bureau of Indian Affairs and the Department of the Interior, but in fact they're a direct shot against Tribal self-government, here on the Flathead
and across the country," Therriault asserted.
The first lawsuit says that the Tribes shouldn't be allowed to set up a management structure for the power division of FIIP, as called for in an already-signed contract. The second suit says that the Joint Board of Control should be able to control not only the irrigation division, but the power system, too.
Therriault pointed out several reasons why Tribal members should be actively concerned over the lawsuits.

The Tribal Council of the Con federated Salish and Kootenai Tribes is now accepting applications from Reservation residents for positions on the Mission Valley Power board of directors.
Responsibilities of the board as defined in the P.L. 93-638 contract for management of the utility include the following:
POWERS. Subject to and consistent with applicable federal and Tribal law and the contract to which this plan of operation is an attachment, the utility board shall manage, operate and maintain the utility, and such authority shall be exercised consistent with and in furtherance of the purposes set
forth above. The utility board's powers include the following:
POLICIES, PLANS AND RATES. To develop and implement such utility policies, plans and schedules of rates and charges as are deemed necessary by the utility board to further the purposes set forth above and to comply with applicable federal and Tribal law and with the contract, to which this plan of operations is an attachment.
LIMITATIONS. Subject to limitations and restrictions as hereafter set forth to manage, maintain, repair, and replace the electric power distribution system and the component parts (Concludes on ðîäå 2)
